Network
The SimpleRack network was built from the ground up to provide maximum reliability to our clients while also delivering the lowest latency and highest throughput possible. We have over 4 bandwidth providers, from Level3, Cogent, Wholesale Internet, and ATT&T.
Hardware
Our robust and scalable network utilizes only routing and switching products from industry-leaders Cisco Systems and Juniper Networks. We use Juniper M-series routers in our border routing layer and Juniper EX4200 and Cisco 3750 series switch stacks in our core switching and aggregation layer. This setup is fully meshed with redundant internal and external fiber connections for maximum reliability. At the client access level we use Cisco access switches for both our public and private networks. These switches are connected in a bonded, redundant fashion to our core layer to not only enhance reliability but to reduce the risk of congestion and provide maximum throughput.
Privacy Policy
Simple Rack, Inc.Commitment to Online Security
Simple Rack, Inc. Data center’s physical, electronic and managerial procedures have been employed to safeguard the security and integrity of personal information. Billing information is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online complaints or requests. All Simple Rack’s Data center staff members with access to personal information obtained on the Simple Rack, Inc. web site are also bound to adhere to this policy. We have a third party MSSP (managed security service provider) that manages a local IDS (Intrusion detection system) This third party has access to data on the network but is bound by confidentially agreements with our company.
How Simple Rack, Inc.Uses Personal Information Collected Online
We will not use your personal information for any purpose other than that for which it is submitted. We use personal information to reply to inquiries, handle complaints, provide operational notices and in program record keeping.

Note: If you violate our acceptable use policy or terms of service, your information may be used to provide additional information to companies such as spamhaus (spamhaus.org) or the Do Not Host Blacklist (dnhbl.com). Information may also be shared with local law enforcement when applicable.
Terms of Service
Violations: Violations of system or network security are prohibited, and may result in criminal and civil liability. Simple Rack, Inc. will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected.
1. You may not upload any material that violates or infringes on the copyright, intellectual property rights or trademark rights of any individual or organization.
2. IRC websites/servers are not allowed.
3. Piracy, hacking, cracking, phreaking, warez, pyrotechnics, exploitative software or text that educates or encourages this activity and/or use is not allowed.
4. You may not upload ROMs and Emulators. This is non-negotiable.
5. You may not publish any material that is grossly offensive, including, exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, or invasion of privacy. This includes material that defames, abuses, harasses or threatens any person or group. Pornography is allowed as long as it meets all U.S. laws and regulations.
6. Spam is not allowed, and you may not reference Simple Rack, Inc. in any unsolicited email that you send.
7. You may not use your service in the commission of any crime that violates the laws of local, state, and federal government of the United States of America.
8. You are solely and fully responsible for the contents of your account. Any and all repercussions will be born solely by you as the account holder.
9. In no event will Simple Rack, Inc. be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use Simple Rack services or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.
10. We reserve the right to terminate any account without warning or notice if any of the TOS or AUP restrictions are violated and we reserve the right to examine the contents of any account at any time.
11. Due to the nature of our industry, we do not offer refunds.
12. Bills are generated on the first of the month due on the 10th. Server disconnects begin after the 10th of the month for unpaid bills. An e-mail requesting payment is sent to you every two days that your bill is unpaid. It is your responsibility to make sure your bill is paid. We do not telephone or send postal mail notifying about disconnects. If you are concerned that an e-mail may not reach you, then you should proactively check your account for bills.
13. A billing dispute of any kind does not exempt you from paying current and future bills. Billing disputes resolved in the customer’s favor will receive account credit for overpayment. A late payment fee of $2.50 may be issued for invoices past due. If your service is disconnected because of an outstanding invoice there may be an additional reconnection fee. If your service is disconnected there is no guarantee that it will not have the data wiped and put back into inventory.
14. We are not liable for any loss of data for any reason. This includes colocation or dedicated servers. It is the customers responsibility to maintain backups of there data.
Acceptable Usage Policy
Violations: Violations of system or network security are prohibited, and may result in criminal and civil liability. Simple Rack, Inc.will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected.
Examples of system or network security violations include, without limitation, the following:
1. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
2. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
3. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.
4. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
5. Use of Simple Rack, Inc. service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
6. Unsolicited commercial e-mail / Unsolicited bulk e-mail (SPAM) Use of Simple Rack, Inc. service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of your account.
Security Violations
You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee.
INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A SIMPLE RACK, INC. CUSTOMER OR A CUSTOMER’S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.
